The City of Moscow has adopted the International Building Code (IBC), which requires all buildings to conform to its standards and any additional standards imposed by the local municipality. Moscow City Code requires all buildings to have a Certificate of Occupancy and a Zoning Certificate.

According to Gregory Dickison, attorney for New Saint Andrews College, this Certificate of Occupancy is “a clear statement from the City of Moscow that New St. Andrews’ use is permitted.” However, one quick glance at the certificate reveals that NSA’s “Zoning Classification” is void.

Moreover, section 110.5 of the IBC authorizes the revocation of a Certificate of Occupancy, “where it is determined that the building or structure or portion thereof is in violation of any ordinance or regulation,” such as the Moscow City Zoning Code.
