On February 16, 2005, New St. Andrews College’s attorney, Gregory C. Dickison, wrote a nine-page letter to Mr. Plaskon in response to the investigation concerning the complaint against New St. Andrews College’s zoning violation. In his letter, Mr. Dickison admits the three most fundamental points central to the complaint, leaving the conclusion to be safely inferred, i.e., New St. Andrews College stands in violation of Moscow City Code:

(1) On page 3, he affirmed, “Only the uses listed for each zoning district are permitted within that district.”

(2) On page 6, he affirmed that New St. Andrews College is an “Educational Institution” as defined by Moscow City Code (which is not a permitted use according to the law).

(3) And on page 4, Mr. Dickison admitted that New Saint Andrews College only has a “Certificate of Occupancy” signed by a subordinate of a building official, conceding that they do not posses the requisite certificate of zoning compliance signed by the Zoning Administrator, as required by law.

Therefore, contrary to their public statements saying otherwise, New St. Andrews College has not complied with Moscow City Code, and they remain in violation of the Code to this day. To read Mr. Dickison’s letter to Mr. Plaskon, click here.
