On August 20, 2003, “Building Official” Edie George, acting for Jim Johnson, signed a Certificate of Occupancy for New St. Andrews to operate college classrooms in the Skattaboe Building (it should be noted that this certificate was provided to the College several months after it was requested by Dr. Atwood). The authorization to use the building for college classes was consistent with the assurances Dr. Atwood received from city officials prior to the purchase and occupancy of the building that the College was within the zoning code. We consider the permit a clear statement from the City of Moscow that New St. Andrews’ use is permitted. . . .
